1. Services Provided
We offer residential home inspection services, including but not limited to standard inspections, wind mitigation inspections, 4-point inspections, mold testing, and other specialized services as listed on the Website.
All inspections are conducted by InterNACHI-certified inspectors in accordance with Florida standards (Florida Statutes § 468.8311) and the InterNACHI Standards of Practice.
Services are visual examinations of accessible areas and do not include destructive testing, engineering analysis, or guarantees of future performance.
We reserve the right to refuse service if conditions are unsafe or access is restricted.
2. Booking and Scheduling
To book an inspection, you may use our online form, email, or phone. Bookings are confirmed upon receipt of a deposit (if required) or agreement to terms.
You must provide accurate property details, including address, size, age, and access instructions. We rely on this information for pricing and preparation.
Scheduling is subject to availability. We aim to accommodate requests within reasonable timeframes, but delays due to weather, emergencies, or unforeseen circumstances may occur.
3. Payment Terms
Inspection fees are quoted based on property size, type, and services requested. Quotes are valid for 30 days.
Payment is due in full upon completion of the inspection, unless otherwise agreed. We accept credit cards, checks, and electronic transfers.
All payments are processed securely through third-party providers. We do not store payment details.
Late payments may incur fees as permitted by Florida law (e.g., interest at 1.5% per month under Florida Statutes § 687.01).
No refunds for completed inspections, but we may offer credits for rescheduling in cases of our error.
4. Cancellation and Rescheduling Policy
Cancellations must be made at least 24 hours before the scheduled inspection to avoid fees. Cancellations within 24 hours may incur a fee up to 50% of the inspection cost.
Rescheduling requires at least 24 hours’ notice and is subject to availability.
If we cancel due to unforeseen circumstances (e.g., inspector illness or severe weather), we will reschedule promptly or provide a full refund.
5. Inspection Process and Reports
Inspections are performed at the scheduled time with your permission to access the property.
You or your representative may attend the inspection but must not interfere with the process.
Reports are delivered electronically within 24-48 hours and include photos, findings, and recommendations. Reports are for your use only and may not be shared without our written consent.
We comply with Florida’s requirement for licensed inspectors to provide written reports (Florida Statutes § 468.8313).
6. Limitations of Inspections
Inspections are visual and non-invasive, limited to accessible areas at the time of inspection.
We do not inspect for hidden defects, code compliance (unless specified), environmental hazards (unless add-on service), or future conditions.
In accordance with Florida law, inspections do not guarantee the absence of defects or predict future performance (Florida Statutes § 468.832).
We are not liable for issues arising after the inspection or from areas not inspected.
7. Warranty and Liability Disclaimer
Our services and reports are provided “as is” without warranties, express or implied, including merchantability or fitness for a particular purpose.
Liability is limited to the amount paid for the inspection, as permitted under Florida law. We are not responsible for consequential, incidental, or punitive damages.
You agree to indemnify us against claims arising from misuse of our reports or failure to disclose known issues.
This limitation does not apply to gross negligence or willful misconduct.
8. Intellectual Property
The Website, reports, logos, and all content are owned by Lundstrom Home Inspections LLC and protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, or use our materials without written permission, except for personal use of your inspection report.
9. User Conduct and Responsibilities
You agree to provide accurate information and grant access to the property for inspection.
You must disclose any known hazards (e.g., structural issues, pets, or security systems).
Prohibited conduct includes:
- Misusing the Website (e.g., hacking, spamming)
- Violating laws or third-party rights
We reserve the right to terminate services for violations.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any disputes arising from these Terms or our Services will be resolved through binding arbitration in Charlotte County, Florida, under the rules of the American Arbitration Association, or in small claims court if applicable.
You waive the right to class actions or jury trials.
